Terms & Conditions of Rental Agreement The Rental Agreement (Agreement) is entered into between Gofun Travel & Tour Sdn Bhd and the person whose name and particulars are as set forth in the Customer Information segment of the Agreement (Customer).   The Customer is desirous of hiring the vehicle, the particular of which are as set forth in the “Vehicle Information” segment of the Agreement (Rental Vehicle) from Gofun Travel & Tour Sdn Bhd and has agreed to let the Rental Vehicle to the Hirer, subject to the terms and conditions as follows:   The present Terms and Conditions establish the rights and obligations of the Customer during use of the Vehicle. The Customer is aware that the right of use of the Vehicle belongs to the Car Hire Company, and that the Customer does not have powers for transfer of the rights and obligations accepted by him or her by conclusion of the Agreement to third persons (among other, for transfer of the right to the Vehicle). Rent or transfer of the Vehicle to third persons is permitted only on the basis of a prior written agreement with the Car Hire Company. The Car Hire Company allows the Customer to use the Vehicle in accordance with the present Terms and Conditions.   Conditions of Use of the Vehicle   1. Malaysia Driving License and International Driving License are applicable to be use during hiring the vehicle. Exception or expatriate or foreign tourists with the valid social pass, they may use valid driving license issued from their origin country.   2. The Customer is responsible for prudent use and careful driving of the Vehicle, and he or she undertakes to use the Vehicle only according to its designated purposes. The Car Hire Company reserves the right to return the Vehicle into its direct possession at any time, if the Customer does not perform the Terms and Conditions of the Agreement.   3. The rates presented on the at least of daily basis rental which subject to 24 hours time length.   4. The rental rates published exclude the cost of the petrol consumed during the rental.   5. The service rates published exclude service tax SST 6%.   6. Hour in excess of one day of hourly rate specified herein, not to exceed another full day’s rental. Late return/ extend hour 4 hours maximum will charge per hour as follow:   Types of Car Price Per Hour Perodua: Axia, Myvi, Bezza Proton: Iriz 15 Perodua: Alza, Aruz Toyota: Vios, Innova 20 Toyota: Camry, Hiace Nissan: Urvan 50   7. Rental & Additional Charge   Where applicable, the customer may also be liable to pay any one or more of the following additional charger to Gofun Travel & Tour Sdn Bhd: Delivery Charges: Where Gofun Travel & Tour Sdn Bhd has been requested by the Customer to deliver the Rental Vehicle to any location other than the Gofun Office, Airport Area and nearby location from which the Rental Vehicle is hired (Rental Location).   Location Pick up / Drop Off Price per Way (RM) GoFun Office, Airport Free Delivery Town (Hotel) 15 Pujut, Lutong, Permy, Tudan, Senadin 25   Off Working Hours: Where Gofun Travel & Tour Sdn Bhd has been requested by the Customer to deliver or collect the Rental Vehicle at a time which is beyond Gofun Travel & Tour sdn Bhd business hours, which is Monday - Friday 8am-5pm, Saturday 8am – 12pm. If the Customer return or collect the car of working hour will be provided Additional charges RM15.   8. The Customer shall promptly pay the Rental and Additional charges before or upon vehicle check out or on due date as may be indicated by Gofun Travel & Tour Sdn Bhd to the Customer in writing.   9. The payment can be made by Cash, Transfer, Debit Card, Credit Card, Cashless (Boost, Sarawak Pay).     Taxation   In the event any Sales And Service Tax (SST) is imposed by the relevant Malaysian authorities on the Rental Charges, Additional Charges and other charges exclude Deposit as may be payable by the Customer to Gofun Travel & Tour Sdn Bhd and shall be entitle to charge the Customer such SST 6% and the Customer hereby agrees to bear the SST.   1. The Customer shall ensure that the Rental vehicle shall not be used:   Whilst under the influence of alcohol or drugs For any purpose for which it is not expressly designed For participate in any race, test or contest To propel or tow any vehicle or other object In any manner whereby the Rental Vehicle will be loaded beyond its permitted capacity For any illegal and/ or unlawful purposes Smoking in the Rental Vehicle is also strictly prohibited The Customer shall be liable to reimburse Gofun Travel & Tour Sdn Bhd for all cost incurred to eliminate such odors and the loss of rental days of the Rental Vehicle Do not remove or interfere with any identification marks or plates affixed to Rental Vehicle, nor attempt nor permit the same Do not deface the paintwork or bodywork of the Rental Vehicle nor add or erect any painting, sign-writing, lettering or advertising to or on the Rental Vehicle Bear the cost of the repair or rectification of any damage to the Rental Vehicle resulting from the negligence/ intentional act/ vandalizing act/ improper use of the Rental Vehicle by any of the Designated Driver Be liable for all missing, stolen or broken parts and / or accessories of the Rental Vehicle as stipulated in the “Vehicle Checklist” form Be liable for the costs of replacement of any loss car key(s) and/ or the costs for the creation of any additional car key(s) for the Rental Vehicle   2. Parking & Traffic Fines: The Customer shall be solely liable for all parking fees, traffic fines, penalties or summonses incurred in respect of the Rental Vehicle during the Rental Period (as defined hereinafter below).   3. Service and Maintenance Of The Rental Vehicle: If the customer experience any problem with the Rental Vehicle during the Rental Period example due to accident or mechanical failure, the customer may seek assistance by dialing the customer service for Gofun Travel & Tour Sdn Bhd number 016-8501800. The customer shall and shall not allow any third party to carry out any service and or maintenance work on the Rental Vehicle without having obtained Gofun Travel & Tour Sdn bhd prior written consent. For the Insurance detail, the customer can ask from the person in-charge.   4. Replacement Vehicle: Gofun Travel & Tour Sdn Bhd shall not be obliged to provide any replacement vehicle to the customer.   5. Insurance & Collision Damage Waivers Etc: The rental charges of the rental vehicle are not inclusive of car insurance coverage of:   Unlimited liability for death or injury to third parties The aforesaid insurance coverage shall only be effective provided if the customer and/ or the Designated Driver Shall have lodged a police report on the accident Shall have reported the accident to Gofun Travel & Tour Sdn Bhd staff within twenty four (24) hours from the time of accident. Upon specific request by the Customer, the Rental Charges may also be inclusive of any one or more of the following insurance, as may be indicated in the agreement: Collision Damage Waiver (CDW) - In the event any loss or damage is caused to the Rental Vehicle, the Customer shall be liable to pay the full costs of such loss or damage to the Rental Vehicle, including but not limited to the labor, towing and storage costs as well as a daily fee for Gofun Travel & Tour Sdn Bhd loss of use of the Rental Vehicle. - However, if the Rental Charges of the Rental Vehicle is inclusive of CDW, the Renter’s liability towards Gofun Travel & Tour Sdn Bhd in respect of the loss or damage caused to the Rental Vehicle shall be limited to a maximum liability as stipulated in the NW Excess Column for Collision Damage in the Agreement. Theft Waiver (TW) - If TW is not included in the Rental Charges of the Rental Vehicle, and the entire or parts of the Rental Vehicle is stolen, the Customer shall be liable for the costs of replacing the stolen vehicle up to a maximum responsibility amount including but not limited the loss of rental days of the Rental Vehicle and where only parts of the Rental Vehicle is stolen, the costs associated with the replacement the stolen part and the recovery and storage of the Rental Vehicle immobilized as a result of the theft. - If TW is inclusive, the Customer liability in respect of the stolen vehicle shall be limited to a maximum liability as stated in the NW Excess column for the “Theft Waiver” in the Agreement. - TW shall not be applicable in respect of : any theft of parts and or accessories of the Rental Vehicle only and any theft of the Rental Vehicle or its parts thereof which occurs when the Rental Vehicle is driven out of Malaysia. (regardless if prior written consent has been given by Gofun Travel & Tour Sdn Bhd) Personal Accident Insurance (PAI) - If the Rental Charges of the Rental Vehicle is inclusive of PAI, death and permanent disability coverage to the Designated Driver(s) and the passenger(s) in the Rental Vehicle will be provided as follows: (a) Sedan Car: Insurance coverage for death and permanent disability up to RM30,000.00 for Designated Driver and RM10,000.00 per passenger, up to a maximum of RM70,000.00 per vehicle (i.e up to a maximum of ONE (1) Designated Driver and FOUR (4) passenger per vehicle.) (b) Multi-purpose Vehicle : Insurance coverage for death and parmenant disability up to RM30,000.00 for the Designated Driver(s) and RM10,000.00 per passenger up to maximum of RM90,000.00 per vehicle (i.e up to a maximum of ONE (1) Designated Driver and SIX (6) passenger per vehicle.) Windscreen Protection Waiver - CDW, TW and the Windscreen Protection Waiver shall only be effective subject to the Customer’s compliance of the following : (a) The Customer shall have lodged a police report within twenty-four (24) hours of the loss/ damage/ theft of the Rental Vehicle. (b) Where applicable, the Customer shall obtain the names, identity card or passport number and addresses of all parties involved, including the witness. (c) The Customer shall not have left or abandoned the Rental Vehicle without adequate provisions for safeguarding and securing the same. (d) The Customer shall promptly notify Gofun Travel & Tour Sdn Bhd of such accident and shall submit a duly completed “Motor Accident Report Form”. (e) The Customer shall give all correspondence, writs or documents of any kind received by the Customer relating to such accident involving the Rental Vehicle and shall fully corporate with Gofun Travel & Tour Sdn Bhd in the investigation and defense of any claim, prosecution or suit. - CDW, TW and Windscreen Protection Waiver shall not be applicable where the Rental Vehicle has been driven or operated in violation of the terms of the Agreement, and the Renter shall be liable to pay Gofun Travel & Tour sdn Bhd the FULL costs of the damaged/ stolen Rental Vehicle and/ or parts thereof, including but not limited to the labor, towing and storage costs as well as Gofun Travel & Tour Sdn Bhd loss of use of the Rental Vehicle. The Customer may purchase any one or more of the above optional insurance by paying the additional fees as indicated in the Agreement.   6. Rental & Period   The rental period for the Rental Vehicle shall commence from the Check out Date & Time as stipulated in the Agreement (Rental Period) If the Customer shall be desirous of continuing with the hiring of the Rental Vehicle after the expiry of the Rental Period, Gofun Travel & Tour may at its absolute discretion renew the Agreement on terms to be mutually agreed by the Parties, including the extension of any of the optional insurance purchases by the Renter In the event the Customer fails to return the Rental Vehicle to Gofun Travel & Tour Sdn Bhd upon the expiry of the Rental Period, the Customer shall be deemed to have agreed to extend the Rental Period, and the Renter shall continue to be liable to pay Gofun Travel & Tour Sdn Bhd the Rental Charges in respect of the Rental Vehicle, which shall be calculated on daily basis, commencing from the date immediately after the expiry of the Rental Period, until the date of return of the Rental Vehicle to Gofun Travel & Tour Sdn Bhd   7. Termination Of The Agreement   Either Party (Non-Defaulting Party) shall be entitle to terminate the Agreement immediately by way of written notification to the other party (Defaulting Party) provided only if:   There has a breach of any of its covenant in this Agreement by the Dafaulting Party The Non-Defaulting Party has notified the Defaulting Party of the breach by way of written notice (Notice of Breach) and requiring the Defaulting Party to remedy the breach within seven (7) days from the date of the Notice of Brech   Upon the expiry or such early termination of the Agreement, the Customer shall:   Pay all to Gofun Travel & tour Sdn Bhd the all arrears of the Rental Charges and/ or additional charges and any other sums which are or becomes due to Gofun Travel & tour Sdn Bhd
